As of November 1, 2022, New York City’s pay transparency law will require most employers to disclose salary ranges in their job postings.
On May 12, 2022, New York City Mayor Eric Adams signed amendments to the New York City Human Rights Law (NYCHRL) that require employers to include the minimum and maximum salary for a position in any advertisement for a job, internal promotion or a job transfer opportunity that would be performed in New York City.
The minimum and maximum salary for the position must reflect the range that the employer believes in good faith it would pay for the role at the time of the posting.
The law applies to all employers with four or more employees, including full- or part-time employees, interns, domestic workers, and independent contractors. Covered employers should follow the new law when advertising for positions that can or will be performed, in whole or in part, in New York City, whether from an office, in the field, or remotely from the employee’s home.
Failure to include the salary range for a position in any covered advertisement constitutes a discriminatory practice that may result in monetary damages to affected employees and civil penalties.
With this increased focus on pay transparency, pay equity will be a critical issue for employers in the years to come. Employers are encouraged to undertake all efforts to ensure they can demonstrate pay equity among their employees.
